Red Star in Cowley Road has been fined £4,700 for failing to comply with their duty of care around waste management under section 47 of the Environmental Protection Act 1990.  

The prosecution was carried out by Oxford City Council’s Community Response Team. 

An investigation into the business originally began due to concerns relating to the storage of waste. However, during a duty of care visit, further issues were identified including concerns about food hygiene and the condition of the kitchen.   

The court date, which took place on 31 October at Oxford Magistrates Court, saw Red Star facing charges related to breaches relating to their commercial waste management.   

A section 47 notice may be issued under the Environmental Protection Act 1990, to businesses and traders, requiring that their waste is suitably stored and does not cause a nuisance.  

The failure to comply with the duty imposed by section 47 of the Environmental Protection Act 1990 resulted in the successful prosecution. 

As a result, Red Star has been issued a fine of £4,700 under section 47, and its Food Hygiene rating has been downgraded to zero.
