A lawful development certificate is an official document from us that confirms your building work or use of your property is legal and doesn’t need planning permission. It gives you peace of mind that your project follows planning regulations and protects you from future enforcement action.

This can be especially useful if:

  • you're planning home improvements and want to be sure they’re allowed under permitted development
  • you’re selling your home and need to prove that past work was lawful, or the current use is lawful
  • you want to avoid issues with neighbours or the Council later on

Types of certificate

There are two kinds of lawful development certificate you can apply for:

  1. Proposed Use or Development - for work you plan to do, like an extension or loft conversion
  2. Existing Use or Development - for work that’s already been done, such as a garage conversion or use as a house in multiple occupation (HMO)

Applying for a lawful development certificate is optional, but doing so can be a wise step to give you clarity and avoid potential issues in future.

For 'Certificates of Existing Use or Development' you should explain in detail why the certificate should be granted and supply supporting evidence to demonstrate this such as a sworn affidavit or statutory declaration (co-signed by a solicitor), photographs, emails, plans, receipts and bank statements etc.

Houses in Multiple Occupation (HMO)

Since 24 February 2012, all properties in Oxford require planning permission for use as a HMO to be considered lawful. Properties that were already in HMO use before this date and have remained in continuous use as such may still be lawful. An HMO licence does not in itself determine a property has a lawful planning use as an HMO.

To formally confirm the lawful use of a property as an HMO, owners can apply for a Certificate of Lawfulness for an Existing Use or Development (CLEUD). This certificate provides legal confirmation that the HMO use is lawful and does not require planning permission.

While applying for a CLEUD is not mandatory, it is strongly recommended. It not only confirms the planning status of the property but also supports applications for longer HMO licences, especially useful if there have been gaps in licensing over the past 10 years.

To qualify, you must provide evidence that demonstrates the property has been in continuous use as a small HMO (three to six non-related individuals living together) or large HMO (seven or more non-related individuals living together) for at least 10 years.

The onus is on the applicant to provide all the information, and you cannot rely on the Council's records.
