Scope

 

Accessibility legislation (on legislation.gov.uk website) states that public sector websites must publish content in an accessible format, unless doing so would impose a disproportionate burden on the organisation. If that is the case, an assessment of the extent to which compliance with the accessibility requirement imposes a disproportionate burden must be carried out.

This is a Disproportionate Burden Assessment for the Qualified Long Term Agreement (QLTA) document which is in PDF format.

  • an easily searchable and indexable version

The Council is under time constraints to send the Qualified Long Term Agreement (QLTA) to leaseholders as part of a formal legal consultation process, known as a S20 consultation, for leaseholders to consider this governance document in advance of a consultation which will ensure leaseholders contribute towards the costs of relevant capital works costs.

As this is required for capital works to commence on affected blocks early in the new financial year, it is requested dispensation is given for the QLTA to be on the website for two months. Beyond this period, the need for the QLTA being on the website can be reviewed.

Other factors
  • We are legally required to make the document available to the public, so the document must be published on the Council’s website
  • Due to the nature of this content, there is a need to publish the document quickly, so we took the decision to publish the PDF as a temporary measure
  • Interest in the document is low - only leaseholders will be focused on the document
  • Requests for accessible versions are expected to be rare
  • We have and will always assist with accessible versions on request
Assessment

The Qualified Long Term Agreement is aimed at a relatively limited number of people with the need to meet time constraints to meet legal and financial planning targets.

We estimate that it would take 4 working days to create a fully accessible version of the document and this would place an undue burden on the Council, given the small number of expected views received.

However, should there be a request for information contained within the document in an accessible format, we will be able to assist.
