Part 4, Section 59
Public Spaces Protection Order - 10 April 2025
Oxford City Council (the Council) in exercise of the power under section 59 of The Anti-Social Behaviour, Crime and Policing Act 2014 (the Act), being satisfied that the conditions set out in section 59 of the Act have been met, makes the following order:
1. The Order applies to the communal areas of Flat 36, 38, 40, 42, 44 Upper Barr AND 207, 205, 203, 201, 199 Barns Road Oxford, OX4 3TX (the Restricted Area):
It shall be an offence for anyone at all times, from remaining on, entering or attempting to enter the communal areas marked in red on the attached map and leading to Flat 36, 38, 40, 42, 44 Upper Barr AND 207, 205, 203, 201, 199 Barns Road Oxford, OX4 3TX
EXCEPT for the habitual occupants of numbers 36, 38, 40, 42, 44 Upper Barr AND 207, 205, 203, 201, 199 Barns Road Oxford, OX4 3TX AND their lawful visitors AND:
(a) Oxford City Council Staff, employees and agents
Oxford Direct Services staff
Oxford Re Value Investments Ltd employees, agents and contractors
Thames Valley Police Officers
Social Services
The Emergency Services
Heathcare Professionals
Adult Social Care
(b) The person has a reasonable excuse.
2. Obstruction of Authorised Person
(a) Any person who attempts to obstruct an Authorised Person in carrying out their duties under this Public Spaces Protection Order shall commit an offence.
(b) Obstruction includes, but is not limited to, giving false information, physically obstructing an Authorised Person, and refusing to comply with any reasonable instruction given to ensure compliance with this PSPO.
3. Definitions
(a) The Authority means Oxford City Council (the Council).
(b) Authorised Person means a police officer, an employee, agent, contractor of the Council or other person who is authorised in writing by the Council.
(c) Restricted Area means the communal area marked in red on the attached map and leading to Flat 36, 38, 40, 42, 44 Upper Barr AND 207, 205, 203, 201, 199 Barns Road Oxford, OX4 3TX
The Restricted Area includes:
a. Both the northern and southern stairwells that provide access to the first-floor communal areas serving Flat 36, 38, 40, 42, 44 Upper Barr AND 207, 205, 203, 201, 199 Barns Road Oxford, OX4 3TX
b. All communal first-floor areas, including the shared washing area by the aforementioned flats
c. The ground-floor walkway adjacent to the southern stairwell, located behind Consol Tanning Studio (185-187 Barns Road), which leads to the Templars Square Service Yard.
(d) The Order applies to all times of day and night.
(e) This Order comes into force on (17 April 2025) and will remain in force for a period of one year from that date.
4. Exemptions
This Order does not apply to premises as described in section 62 of the Anti-Social Behaviour, Crime and Policing Act 2014.
5. Penalty
(a) Any person who, without reasonable excuse fails to comply with paragraph 1 of this Order shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale.
(b) Any person who, without reasonable excuse fails to comply with paragraph 2 of this Order shall be guilty of an offence and liable on summary conviction to a fine not exceeding' level 3 on the standard scale.
6. Challenging the Validity of Orders
An interested person may apply to the High Court to question the validity of
a) This Order, or
b) A future variation of this Order.
"Interested person" means an individual who lives in the restricted area or who regularly works in or visits that area.
An appeal against this Order or a future variation of this Order may be made to the High Court within six weeks from the date on which the order or variationis made, on the grounds that:
a) Oxford City Council did not have power to make the order or variation, or to include particular prohibitions or requirements imposed by the order (or by the order as varied);
b) a requirement under Chapter 2 of the Anti-Social Behaviour, Crime and Policing Act 2014 was not complied with in relation to the order or variation.
